Terms of Service

1. About these terms
These terms of service ("Terms") govern your access to and use of PrimaryAI, a web-based lesson planning and education workflow platform ("Service") operated by Onepoint Software ("we", "us", "our"). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.
2. Who may use the Service
The Service is intended solely for adults (aged 18 or over) who are qualified teachers, school staff, or education professionals working in or around primary education in the United Kingdom. You must not use the Service:
- if you are under 18 years of age
- on behalf of pupils or children
- for any unlawful purpose or in violation of any applicable law or regulation
- in a way that could harm children or compromise safeguarding obligations
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately if you suspect unauthorised access to your account. We reserve the right to suspend or terminate accounts that breach these Terms.
You must provide accurate information when registering. One account per individual user unless otherwise agreed in writing.
4. Acceptable use
You agree not to:
- enter any personal data relating to identifiable pupils into the Service, including names, dates of birth, assessment records, or any other information capable of identifying a child
- use the Service to generate, store, or distribute content that is unlawful, harmful, defamatory, discriminatory, or offensive
- attempt to reverse engineer, scrape, or otherwise extract data or source code from the Service
- share your account credentials with others or allow third parties to access the Service through your account
- use the Service in any way that could damage, disable, overburden, or impair it
- use automated means (bots, scrapers, crawlers) to access the Service without our prior written consent
5. Pupil data and safeguarding
PrimaryAI is designed to help teachers plan lessons using anonymised class-level information — such as year group, subject, ability percentages, and EAL proportions — without processing personal data about individual pupils. You must not enter any information into the Service that could identify a specific child.
You are responsible for complying with your school's data protection policy, your obligations under the UK GDPR and the Data Protection Act 2018, and the DfE's "Keeping Children Safe in Education" guidance when using the Service. We are not responsible for any breach of those obligations arising from your use of the Service.
6. AI-generated content
Lesson packs and other content generated by the Service are produced by third-party AI models. All AI-generated content is provided as a starting point for professional teacher judgement. You must review and verify all generated content before using it with pupils. We make no warranty that AI-generated content is accurate, curriculum-compliant, or suitable for any particular class or individual.
Generated content is not a substitute for your professional expertise and statutory safeguarding responsibilities. You are solely responsible for any decisions you make on the basis of AI-generated content.
7. Intellectual property
The Service, including its design, software, and underlying technology, is owned by us and protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Service for its intended educational purpose during the term of your subscription.
Content you create or save within the Service (such as lesson packs, notes, and custom edits) remains yours. You grant us a limited licence to store and process that content solely to provide the Service to you.
8. Subscriptions and payment
Some features of the Service require a paid subscription. Subscription fees are charged in advance on a recurring basis. All fees are non-refundable except where required by law or expressly stated otherwise. We may change subscription pricing on reasonable notice; continued use after a price change constitutes acceptance of the new price.
Payments are processed by Stripe. We do not store your payment card details. Stripe's own terms and privacy policy apply to payment processing.
9. Availability and changes
We aim to provide a reliable Service but do not guarantee uninterrupted availability. We may modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where practicable. We will not be liable for any loss caused by unavailability or changes to the Service.
10. Disclaimer of warranties
The Service is provided "as is" and "as available". To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service is error-free, secure, or that AI-generated content is accurate or suitable for your needs.
11. Limitation of liability
To the fullest extent permitted by law, our total liability to you for any claim arising out of or related to the Service shall not exceed the fees paid by you in the twelve months preceding the claim. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or reputational damage, even if we have been advised of the possibility of such damages. Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable law.
12. Data protection
Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms. By using the Service you acknowledge that you have read and understood the Privacy Policy.
13. Termination
You may cancel your account at any time via the account settings. We may suspend or terminate your access immediately if you breach these Terms or if we are required to do so by law. On termination, your right to use the Service ceases and we will handle your data in accordance with the Privacy Policy.
14. Governing law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless applicable consumer protection law provides otherwise.
15. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice within the Service. Continued use of the Service after the effective date of revised Terms constitutes your acceptance of those changes.
